इस अधिनियम, उसके तहत  आयोग द्वारा बनाये गए नियमों  या कोई आदेश या निर्देश के गैर अनुपालन या किसी प्रावधान का उल्लंघन , एक दंडनीय अपराध होगा जिसके लिए पांच वर्ष तक कारागार की सजा या एक करोड़ रुपये तक का अर्थदंड या दोनों का प्रावधान है ।

 

अपराध असंज्ञेय होगा और प्रथम श्रेणी के न्यायिक मजिस्ट्रेट द्वारा विचारणीय होगा ।

 

Any Non-compliance or contravention of any provisions of this Act, rules made thereunder or any order or direction issued by the Commission, shall be an offence punishable with imprisonment for a term which may extend upto five years or with fine which may extend upto one crore rupees or with both. 

 

The Offence shall be Non-Cognizable and triable by Jurisdictional Magistrate of the First Class.
